REgulations on the Commission of Permanent Representatives to the Eurasian Economic Community of 27 February 2003
I. GENERAL PROVISIONS
1. Work of the Commission of Permanent Representatives of State – Members of the Eurasian Economic Community (hereinafter referred to as the Community) to the Eurasian Economic Community (hereinafter referred to as the Commission of Permanent Representatives) is governed by the Treaty on the Establishment of the Eurasian Economic Community of October 10, 2000, as well as by Regulations on the Integration Committee of the Eurasian Economic Community, and the appropriate resolutions of the Interstate Council of the Eurasian Economic Community. The Commission of Permanent Representatives conducts its activities in accordance with the present Regulations and the Rules of Procedure as approved by the Commission. 2. The Commission includes Permanent Representatives of States – Members of the Eurasian Economic Community (hereinafter referred to as the Permanent Representatives) appointed by heads of states – members of the Community. 3. The Commission of Permanent Representatives is located at the seat of the Integration Committee, in the city of Almaty, Republic of Kazakhstan, and in the city of Moscow, Russian Federation. As decided by the Commission of Permanent Representatives, the Commission may meet at any city in any of the states – members of the Eurasian Economic Community. In this case, the receiving state shall provide all conditions required for organizing and conducting the Commission’s meetings. Financing for meetings of the Commission of Permanent Representatives shall be provided out of the Community’s budgetary funds. 4. The Commission of Permanent Representatives shall meet as the need arises, but no less than twice every three months. A meeting of the Commission of Permanent Representatives has the due authority if it has been attended by Permanent Representatives of all states – members of the Community or by persons authorized by the respective states to act temporarily as Representatives’ deputies.
II. FUNCTIONS OF THE COMMISSION
5. The main functions of the Commission of Permanent Representatives are to: – ensure a regular efficient work of the Community; – ensure convergence and reconciliation of the member states’ positions on such issues as strengthening cooperation and deepening integration within the Eurasian Economic Community; – ensure interaction between the Community and the appropriate organs, institutions and organizations of the states – members of the Community. 6. The Commission of Permanent Representatives consider: – positions and proposals of the states – members of the Community on questions pertaining to cooperation and on drafts of documents currently drawn up; – proposals and drafts of documents introduced at the meetings of the Integration Committee prepared by the Secretariat of the Integration Committee of the Eurasian Economic Community, by the Interparliamentary Assembly of the Eurasian Economic Community, as well as by subsidiary organs of the Community, and by committees and councils set up by the Integration Committee of the Eurasian Economic Community, also questions pertaining to the current work of the Community, and decide thereon; – proposals, recommendations, inquiries of the Community’s organs; – proposals and inquiries received by the Community from states with observer status, as well as from the third-party states and international organizations. 7. The Commission of Permanent Representatives approves plans/schedules to prepare documents and other papers for meetings of the Integration Committee of the Eurasian Economic Community. 8. The Commission may introduce its own proposals and initiatives. 9. Resolutions adopted by the Commission on the questions under consideration are entered into official records signed by all members of the Commission. 10. The Commission of Permanent Representatives adopts resolutions by a majority of two-thirds of the votes. In case any of the Permanent Representatives has a separate opinion, it adjoins the official record of the resolution of Commission of Permanent Representatives, and the question is referred to the Integration Committee of the Eurasian Economic Community for consideration. 11. The Commission of Permanent Representatives adopts resolutions, which are: – recommendations to member states of the Eurasian Economic Community, as well as to organs of the Community and to committees and councils set up by the Integration Committee of the Eurasian Economic Community; – mandatory to the Secretariat of the Integration Committee of the Eurasian Economic Community. 13. Following resolutions of the Interstate Council and the Integration Committee of the Eurasian Economic Community, the Commission of Permanent Representatives implements measures aimed at convergence and reconciliation of the positions of states – members of the Community and at improvement of the Community’s performance. As part of its work the Commission of Permanent Representatives shall also consider proposals by the General Secretary of the Eurasian Economic Community. Executive offices of the Permanent Representatives interact directly and on a regular basis with organization departments of the Secretariat of the Integration Committee of the Eurasian Economic Community.
III. PROCEDURE OF WORK
14. Chairmanship of the Commission’s meetings for the period of a year are by rotation in accordance with the order of the Russian alphabet, starting with the name of the country of which the representative has been elected Chairman of the Interstate Council of the Eurasian Economic Community at the Council’s first meeting. 15. The General Secretary of the Eurasian Economic Community, employees of the Secretariat of the Integration Committee of the Eurasian Economic Community and of the Secretariat of Bureau of the Interparliamentary Assembly of the Eurasian Economic Community, as well as other persons by invitation of the Commission may attend meetings of the Commission of Permanent Representatives of the Eurasian Economic Community. 16. The agenda to be considered at a meeting of the Commission of Permanent Representatives drawn at the previous meeting of the Commission based on respective resolutions of organs of the Eurasian Economic Community, proposals of states – members of the Eurasian Economic Community, as well as of subsidiary organs of the Community, of councils and committees set up by the Integration Committee of the Eurasian Economic Community, of the Secretariat of the Integration Committee of the Eurasian Economic Community and the Secretariat of the Interparliamentary Assembly of the Community, with consideration of applications and inquiries submitted by the states with observer status, as well as by other states and organizations. The proposals are submitted as draft documents accompanied by papers justifying their consideration. The agenda formed at the previous meeting of the Commission may include additional questions of higher priority and requiring urgent consideration. The additional questions are introduced based on respective resolutions of organs of the Eurasian Economic Community, proposals of member states of the Eurasian Economic Community, as well as of subsidiary organs of the Community, of councils and committees set up by the Integration Committee of the Eurasian Economic Community, of the Secretariat of the Integration Committee of the Eurasian Economic Community and the Secretariat of the Interparliamentary Assembly of the Community, with consideration of applications and inquiries submitted by the states with observer status, as well as by other states and organizations. 17. Documents submitted to the Commission of Permanent Rep-resentatives for consideration are received by the members of the said Commission not later than 30 days before the question shall be considered on the point of substance. The exceptions are urgent questions considered by order of Chairman of the Interstate Council of the Eurasian Economic Community, of Chairman of the Integration Committee of the Eurasian Economic Community or at the suggestion of the General Secretary of the Eurasian Economic Community. 18. The Secretariat of the Integration Committee of the Eurasian Economic Community provides organizational and information support for activities of the Commission of Permanent Representatives. 19. At the suggestion of the Commission of Permanent Representatives or of the states – members of the Eurasian Economic Community, amendments to the present Regulations may be introduced by resolution of the Integration Committee of the Eurasian Economic Community. __________
