PROTOCOL on the procedure for conducting mutual consultations on external border defense issues of the Eurasian Economic Community member-states
Article 1
Consultations on the issues of defense of external borders of the Eurasian Economic Community member-states shall be conducted as and when needed, with participation of the heads of the frontier guard agencies of the Parties or their deputies as well as invited specialists and consultants.
Article 2
The main objectives of the consultations shall be as follows: – elaboration of proposals for realization of measures and activities for the development of cross-border cooperation of frontier guard forces in various aspects of their work; – elaboration and preparation of proposals for performing coordinated joint activities in order to ensure external border security.
Article 3
In the course of consultations the frontier guard agencies of the Parties shall inform each other about the situation on the state border, as well as military, political and social and economic processes that are underway in the border areas, and activities aimed at ensuring the security of external borders. Article 4
In case of situations requiring urgent decisions, the frontier guard agencies of the Parties shall conduct consultations in smaller delegations.
Article 5
With the mutual consent of the participants of the consultations, they may be attended by representatives of other interested ministries and agencies of the Parties.
Article 6
The agenda and the procedure of conducting consultations shall be determined by the participants of these consultations. Consultations shall be presided over by the head of the frontier guard agency of the host Party, and in exceptional cases the chair-person may be elected by the participants of these consultations.
Article 7
Expenses related to organization of these consultations shall be covered by the frontier guard agency of the host Party. Expenses related to trips of the participants to the site of consultations shall be covered by each Party’s frontier guard agency. Expenses related to participation of representatives of other interested ministries and agencies of the Parties shall be covered by the Party’s interested ministries and agencies. The host Party shall be responsible for security of the participants at these consultations.
Article 8
When considering issues affecting interests of third states, their representatives may participate in a consultation only with consent of the participants of this consultation.
Article 9
The results of these consultations shall be recorded in the corresponding final documents to be submitted to the heads of frontier guard agencies. By mutual agreement, the final documents may have a confidential character.
Article 10
This protocol shall be an integral part of the Treaty on cooperation in the protection of external borders of the member states of the Eurasian Economic Community and shall enter into force and be effective on the terms and in the order provided for by the Treaty.
