The government of the have agreed as follows: Article 1 Each Party shall create a list of goods supplied to states which are not parties to this Agreement (hereinafter “third countries”) and to which, as of the effective date of this Agreement and in accordance with the national legislation of the Party, export duties apply, including the rates of these duties (hereinafter “the list of goods”), and within 30 calendar days of the effective date of this Agreement shall submit it to the Commission of the customs union, established in accordance with the Treaty on the Commission of the customs union, dated 6 October 2007 (hereinafter “the Committee”). Within 60 calendar days of the effective date of this Agreement, the Commission shall establish a joint list of goods supplied to third countries to which, in accordance with the national legislation of the Parties, export duties apply, including the rates of these duties (hereinafter “the joint list of goods”), and shall send it to the Parties.
Article 2
The objective of the Parties shall be to unify the lists of goods and the rates of export duties. The Parties shall not unilaterally extend the lists of goods, except for cases which shall be determined by a separate agreement between the Parties. Article 3 If a product made on the state territory of one Party levying export duties on this product is supplied to a third country from the state territory of another Party not levying export duties on this product or levying lower rates of export duties, this other Party shall ensure that export duties are levied at the rates effective in the state of the Party on whose territory the product is made, and indicated in the joint list of products. Article 4 If one of the Parties makes changes to the lists of goods or the rates of export duties with the concurrence of the Parties or on the basis of an agreement concluded in accordance with the Article 2 of this Agreement, this Party shall inform the Commission of changes proposed and made. The Commission shall amend the joint list of goods and inform the Parties of the respective changes. Article 5 Disputes arising in connection with the application or interpretation of the provisions of this Agreement shall be settled by means of mutual consultations and negotiations between the Parties and, in the case of failure to achieve an agreement, shall be submitted for adjudication to the Court of Justice of the Community. Article 6 Upon agreement between the Parties, this Agreement may be subject to changes which shall be formalised by separate protocols.
Article 7 The procedure for entry into force of this Agreement, acceding thereto and withdrawing therefrom shall be laid down by the Protocol on the procedure for entry into force of international treaties aimed at establishing the contractual and legal framework of the customs union, and withdrawal from them and accession to them, dated 6 October 2007.
